This privacy policy (the “Privacy Policy”) describes Torch Technology, Inc. (“Torch”) practices regarding personally identifiable information and other information (the “Personal Information”). This Privacy Policy applies to our website, application, email and text messages, social media accounts, and use of our services (collectively, the “Site” or “Sites”).
When you use the Sites, you agree to the terms of this Privacy Policy. This Privacy Policy is subject to and incorporated into our Terms of Service.
What is Personal Information?
The term “Personal Information” means information that identifies, relates to, or could reasonably be linked to you or your household, directly or indirectly.
2. We collect and use the following information
A. Information You Give Us
You provide us information such as, without limitation, your name, business address, phone number, or email address, when you register for an account; when you search for a product; place an order through one of the third-party Vendors accessible on our Sites; or communicate with us by phone, email, or text messaging.
B. Automatic Information
When you visit the Sites, we may automatic collect technical information such as, without limitation, the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information such as browser type, version, and time zone setting, browser plug-in types and versions, operating system, and platform; purchase history; the full Uniform Resource Locator (URL) clickstream to, through, and from our Sites, including date and time; or products you viewed or searched for. We may also use browser data such as cookies, or similar data on certain parts of our Sites to improve the user experience, fraud prevention, diagnostic purposes, and other purposes. We also may use software tools such as JavaScript to measure and collect session information, including page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), and methods used to browse away from the page.
C. Information from Other Sources
We collect data related to your previous order history from those Vendors accessible through our Sites. These data points may include, SKUs, pricing for products purchased or viewed, quantities purchased, purchase dates, and other information related to each order you have placed, including address information. We associate this information with your account.
We use third-party payment processors to facilitate payments through the Sites; however, we do not have access to your financial, payment, or credit card information. Please note that this Privacy Policy does not apply to these third parties.
3. How We Use Your Personal Information
We may use your Personal Information as follows:
- To improve our Sites and services, better understand the users of our Sites and services, and protect the Sites.
- To remember your username and account information next time you log in to the Sites.
- As necessary to perform the services and provide you products that you have requested from us and Vendors accessible on our Sites.

- To help us measure traffic and usage trends for the Sites utilizing third-party analytics tools. These tools collect information sent by your device or our Sites, including the web pages you visit, add-ons, and other information that assists us in improving the Sites. We collect and use this analytics information with analytics information from other users so that it cannot reasonably be used to identify any particular individual user.
4. Cookies and Tracking Tools
We use several common tracking tools such as, without limitation, cookies, web beacons and/or pixels, to improve the performance of the Sites, to collect usage and demographic information about visitors over time, to track new visitors to the Sites, to prevent fraud to help improve our Sites and for capacity planning purposes, and to understand interactions with our emails. We do not use this information to personally identify you.

The cookies sent by the Sites are used only by the Sites and are not used to collect Personal Information without your permission. If you choose to provide us with personal information (such as your email address), that information could be linked to the data stored in the cookie. We reserve the right to change our use of cookies and our practices regarding linkage to Personal Information without prior notification.
Please also note that opting out of a third party cookie does not mean that you will no longer receive or be subject to online advertising or marketing. It means that the third party service from which you opted out will no longer deliver ads tailored to your web preferences and online behavior. This means that Torch will no longer use information derived from your online behavior, collected by Torch or third parties acting on behalf of Torch, for the purpose of providing you interest-based advertising from Torch only.
We also use web beacons and pixels on the Sites and in our emails to you. For example, we may place a pixel in marketing emails that notify us when you click on a link in the email. We use these technologies to operate and improve our Sites and emails.
5. Analytics
We may also use Google Analytics to collect demographic and interest data about you (such as age, gender, and interests), including through Google Analytics Demographics and Interest Reporting. We may use the information collected about you through Google Analytics for Google services such as Remarketing with Google Analytics and Google Display Network Impression Reporting.

6. Third-Party Websites
Our Sites may contain “links” to other websites owned or managed by third parties. We cannot be responsible for the content or privacy practices employed by these other websites. We encourage you to review the privacy policies of these websites before disclosing any Personal Information to or through them. We are not responsible for the privacy practices employed by any third-party websites or services linked to or from our Sites, including the information or content contained within them. Please remember that when you use a link to go from our Sites to another website or service, our Privacy Policy does not apply to those third-party websites or services. Your browsing and interaction on any third-party website or service, including those that have a link on our Sites, are subject to that third party’s own rules and policies. In addition, you agree that we are not responsible and do not have control over any third parties that you authorize to access your Personal Information. If you are using a third-party website or service and you allow them to access Personal Information, you do so at your own risk.
7. How We Share Your Personal Information
We may share your Personal Information with service providers who perform services on our behalf and are contractually obligated to protect and not further disclose your Personal Information, including aggregated and/or anonymized information about purchase trends to inform them about popular products and/or competitive pricing data.
If you purchase any products through the Sites, we may share your Personal Information with the Vendors from which you have bought products. These third parties will process your Personal Information as data processors or data controllers in accordance with their own privacy policies.
If you contact our customer support, they may need to share information about your request with the relevant Vendor in order to assist you.
We may disclose Personal Information if required by law, for example to law enforcement or other authorities. This includes court orders, subpoenas, and orders arising from legal processes, or administrative or criminal investigations. We may also disclose your Personal Information if the disclosure is necessary for the prevention, detection or prosecution of criminal acts or to prevent fraud or other damage, or in response to a legal action or to enforce our rights and claims.
No mobile information will be shared with third parties/affiliates for marketing/promotional purposes. All the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
In the event that we enter into a business transaction, such as a merger with or an acquisition by another company, or a sale of some or all of our assets, your Personal Information may be among the assets that are transferred or disclosed in connection with such a transaction.
You will be notified via email of any change in ownership or uses of your Personal Information, as well as any choices you may have regarding your Personal Information. We may remove parts of data that can identify you or combine your information with other information in a way that it is no longer associated with you. We may share such aggregated information with others.
8. Lawful Basis for Processing
We have a lawful basis for our processing of your Personal Information, including processing for our legitimate interests (when balanced against your rights and freedoms), to fulfill our obligations to you under a contract with you, and required by law, and with your consent, as described below:
A. Consent
By using our Sites, you consent to our collection, use, and sharing of your Personal Information as described in this Privacy Policy. If you do not consent to this Privacy Policy, please do not use the Sites.
B. Legitimate Interests
We will process your Personal Information as necessary for our legitimate interests. Our legitimate interests are balanced against your rights and freedoms, and we do not process your Personal Information if your rights and freedoms outweigh our legitimate interests. Our legitimate interests may include safeguarding our IT infrastructure and intellectual property.

9. Located in the United States
Torch is located in the United States Your Personal Information will be stored on our servers and data centers located in the United States. Information that we collect will be stored and processed in the United States in accordance with this Privacy Policy. This Privacy Policy shall apply even if we transfer Personal Information to other countries. By accessing the Sites, you consent to this transfer, processing, and storage of your Personal Information in the United States or other jurisdictions, including to jurisdictions in which the privacy laws may not be as comprehensive as those in the country where you reside. Note that your Personal Information may be available to the United States government or its agencies under legal process in the United States.
10. How We Store and Protect Your Personal Information
Torch has implemented a security program that includes appropriate administrative, technical and physical safeguards intended to keep the Personal Information stored in our systems protected from unauthorized access and misuse. Our systems are configured with data encryption, or scrambling technologies and common industry available firewalls. We also use Secure Socket Layer (SSL) technology that is designed to protect the data you send over the Internet. Personal Information may only be accessed by persons within Torch, or our third party service providers authorized to carry out the uses indicated in this Privacy Policy.
Please be aware, however, that no information system is totally secure, and therefore we cannot guarantee against all potential security breaches. While we will use reasonable security and monitoring controls in accordance with general industry standards to secure information you provide to us consistent with our legal requirements, we cannot guarantee that such information will not be unlawfully or illegitimately obtained by unauthorized parties.
11. Retention Periods
We will retain your Personal Information for as long as your account is active and for a limited period of time thereafter to allow you to re-activate your account without loss of information. We will also retain your Personal Information as necessary to comply with our legal obligations and internal record keeping requirements, resolve disputes and enforce our contracts.
12. Changes to the Privacy Policy
We may modify this Privacy Policy at any time and without prior notice. We may notify you about such a material change by email or prominent notice on our website. By using our services and Sites after we post these changes, you indicate you accept them. Please ensure to periodically review this Privacy Policy for updates.
13. Your Choices
You can manage your communication preferences in your account. If we send you marketing or promotional emails, our emails will include an opt-out URL and you can unsubscribe from such communications at any time. Be advised that you cannot unsubscribe from transactional emails and administrative messages that are considered part of your account membership, unless you cancel your membership.
14. Your Rights With Respect To Personal Information
You are entitled at any time to obtain information about your Personal Information that we store, in accordance with applicable law. You may request that we rectify any of your Personal Information that is incomplete or incorrect, including, deleting your user account. You have the right to withdraw your consent at any time to our use of your Personal Information, without affecting the lawfulness of our processing based on such consent before it was withdrawn. Please note that if you request that we delete your information, it may impact our ability to continue to provide our services to you and may result in the deletion of your account.
We may request proof of your identity before acting upon any request. We may not be able to allow you to access certain Personal Information in certain instances, such as, without limitation, if your Personal Information is connected with Personal Information of other users, or for legal reasons. In those instances, we will provide you with an explanation why you cannot obtain your Personal Information. We may also deny your request for deletion or rectification of your Personal Information due to statutory provisions, especially those affecting Torch’s accounting, processing of claims, and mandatory data retention, which may prohibit deletion or anonymization.
15. California Privacy Rights
A. “Shine the Light” Law
California residents with whom we have an established relationship have the right to request certain information with respect to any personal information that a business may have shared with third parties for their direct marketing purposes. Alternatively, we may provide a cost-free means to opt out of such sharing. Note, however, that Torch does not disclose your personal information to other companies for their marketing purposes. For California residents under the age of 18 and registered users of our Site(s), California law (Business and Professionals Code § 22581) provides that you can request the removal of content or information you posted on websites. Be advised, however, that applicable law may not permit us to completely or comprehensively remove your deleted content or for other reasons as set forth in this California law.
16. Children
The Sites are not directed to or intended for children under 18. We do not knowingly collect information from persons under 18.
